    I am the person who's indicated on the payment information given and I am 18 years of age or older. I do agree to the
    Customer Purchaser Responsibility and it's terms as stated below. I also understand that I am buying a motorized
    vehicle online and it is my responsibility to adhere to my local state laws for such and will follow the guidelines given
    by JoyRideMotors.com | San West, Inc. when filing claims, document requests or any other requests for service by
    JoyRideMotors.com | San West, Inc. . I also agree that JoyRideMotors.com | San West Inc. will not be held responsible
    for anything other than the sales agreement to deliver as stated. I understand that riding a motorized machine can
    cause injury that could result in death if misused or abused.

    TAX::: Joy Ride Motors is a California Based Company. All orders originating from within the State Of California, and
    set for delivery withing the State of California, will be charged the standard California sales tax rate on the total amount
    of the order. In the unforeseen event that our check out system does not charge you sales tax, you are still inevitably
    responsible for the payment of the sales tax on your order, and by Law, Joy Ride Motors is responsible to collect the
    sales tax, in spite of any malfunction of our check out system. In such and unforeseen event, this mandatory sales tax
    will be automatically charged to the same card that was used to place your order.

    1) PRODUCT DESCRIPTIONS:

    In Most cases, All Joy Ride 'DESIGNATED' Vehicles are products imported and/or manufactured by other distributors.
    Joy Ride Motors titles our offerings with our own naming conventions. This is for marketing and advertising
    purposes, and the product you purchase may well arrive with 'other-than' the Joy Ride Motors designated
    labeling under which its marketed on the Joy Ride website. Please do not worry, we did not send you the wrong
    vehicle. This is because many of the distributors we work with import identical vehicles from all the same overseas
    manufacturers, giving us multiple vendors to source your order. Therefore, the chosen name designations for most
    Joy Ride vehicles are exclusive to Joy Ride Motors in most cases, and may well differ from the names which the
    product manufacturers, and the stateside distributors use for their internal purposes, sales and marketing efforts.

    By shopping on this website you agree to the terms that you understand some units may have slight variations
    with color and options. Due to the high rotation of volume we process and MFG standards, some products may have
    slight upgrades or changes that we are unaware of. This is due to the high volume and low cost we secure these
    sales at for you. It must be understood that this is a price driven site and color options / schemes may change slightly.
    We must collect (2) separate color choices from you at the time of sale. If we do not contact you, it can be assured you
    will receive one of the two colors you select. By shopping online you assume the responsibility for this. If your model
    arrives with a different color accessory, we will attempt to resolve this for you however the final word will be from the
    MFG directly. We appreciate your wholesale shopping business and ask you to consider this information before
    placing an order. Our main goal is to deliver the most affordable means or fun and transportation to you. Slight
    variations in options can happen and do occur. We attempt to be as accurate as possible in our product pictures
    and specifications. Some specifications published on our site come from the manufacturers and/or distributors.
    These specifications represent ideal circumstances; we cannot guarantee that product descriptions/specifications,
    pricing or any other content is 100% accurate, complete or current. In the event that a product is published incorrectly
    due to typographical, informational, technical or other error, we have the right, at our sole discretion, to either honor the

    2) FREE SHIPPING POLICY and AGREEMENT:

    1. Our FREE standard shipping policy applies to the majority of our products throughout the (lower 48) Continental US.
    Regrettably, If you live in Hawaii, Alaska, Puerto Rico, any US Common Wealth or overseas, our FREE Delivery policy
    does not apply to you. If you reside outside the lower 48 states, and you wish to order one of our vehicles or products,
    please call us at 1-877-300-8707 to receive a custom shipping quote for the vehicle you wish to purchase.
    2. Our FREE shipping policy extends to standard residential tail gate delivery for most urban and suburban settings.
    In very rare cases, should you reside in a rural area that is not serviced by our primary delivery company(s) and it
    becomes cost prohibitive for to fulfill your order, you’ll be notified immediately of the complication and we’ll work with
    you to figure out the least expensive fulfillment option. If you’re not satisfied with the difference in price, you may cancel
    your order with no penalties for a full refund.
    3. Our FREE Shipping offer only covers LTL trucking deliveries attached to a moving pallet. Large and heavy vehicles
    such as; dune buggies, electric car, or similar that require full assembly, special handling and custom transportation
    on a flatbed truck or car-carrier do not include Free Shipping. These custom delivery methods are not factored into our
    'shipping inclusive' price, as they are all individually shopped and quoted by different couriers based on your delivery
    location. If you are not satisfied with our best efforts to procure the lease expensive options for fulfillment, you may
    cancel your order with no penalties for a full refund.
    4. If you're outside of the US, then your order will need to be sent international delivery, which includes additional
    handling and service charges that will need to be priced out and charged separately. In addition, we cannot guarantee
    our customary time frame for deliver. This will depend of where you are in the world, and if you are willing to pay for
    expedited shipping and handling for the delivery of your vehicle. Additionally, there may be reduced limitations in the
    standard manufacturer’s warranty and additional shipping costs would be involved in sending parts should you ever
    have a warranty claim.
    5. Your order is processed anywhere from 3 – 5 Business days after it is placed online. We ship all products from a
    warehouse setting. At times we may ship from our warehouse or directly from the manufacture warehouse in one of
    several locations in the US. We always do our best to get your order out as quickly as possible, but we can only work
    as fast as our warehouses, weather and road conditions permit. Orders normally take 5 to 15 business days in transit
    from the time they are shipped until they arrive at your door. During holiday season, due to extremely high volume, and
    only in some cases, it may take up to 21 business days for transit. If at any time the item you originally purchase is not
    in stock we'll offer an optional item of equal or greater value as our commitment to customer service to fulfill your order.
    6. Joy Ride Motors operates under an expedited system and once a sale is generated, we treat that sale with great
    responsibly under the assumption that our customer did their research before buying and selected us for our price
    point and quality of customer service and product support. Once the order is placed, the terms and conditions of this
    sales agreement are in full effect for both Joy Ride Motors and the customer, who assumes responsibly to ensure
    payment is honored. For security reasons, If you place a credit card order and your shipping address and billing
    address are different, we may need you to complete and sign an authorization form prior to shipping your order.
    7. All products over 100 Lbs. are shipped by a professional LTL trucking company. Products weighing under 100 Lbs.
    are shipped by FedEx Ground.
    8. You will be emailed all the necessary the tracking information after your order has been physically placed on a
    shipping truck for delivery. You can go to the shipping company's website to track your shipment activities.
    9. When your delivery arrives, it will be on a truck equipped with a hydraulic tail gate to lower your vehicle to street level.
    It is very important that you examine the state of the packaging. The protective cardboard shell may have some rips,
    tears and be crushed in places. Please do not get overly concerned about the state of the exterior of the protective
    packaging which may looked a little beat up. Its purpose it to absorb any bumps and bruises during transportation so
    that your vehicle does not. The insides, as you will see, are very tightly packed, well stored and safe. 99.9% of the time,
    deliveries are perfectly fine on the inside, regardless how torn up the outside appearance may appear. But it’s always
    better to be safe. So make sure to examine the delivery very thoroughly before shipping the Bill of Lading (BOL).
    Underneath the cardboard shell is a sturdy metal cage atop a wooden pallet that protects your vehicle. If any part of this
    metal cage is exposed or protruding through the cardboard shell, then it’s important that you make a note of that on the
    ‘shipping check-off sheet’ prior to signing the Bill of Lading (BOL) and accepting delivery. Inspect the cardboard shell to
    make sure the protective metal cage below is not loose, crushed in, or broken. If it appears that there may be damage,
    the cardboard is excessively torn, the box stands lopsided and is not square, or parts of the metal safety cage is bent
    or mangled... then you should call us right away at 877-300-8707 so we can help you figure it out the next step. If you
    have concerns hold off on signing the BOL. Ask the delivery driver to help you remove the cardboard shell to make
    sure the safety cage is in tack and not compromised before you sign for it. As long as the protective safety cage is in
    good shape, then you should accept the delivery. If you reject the shipment based solely on damages to the packaging,
    yet the vehicle itself is not damaged, you will likely be charged a non-refundable restocking fee and/or the cost of the
    return shipping.
    10. If there is any substantial damage, it’s very important you be as detailed as possible in describing the size
    and location of any visible shipping damage on the shipping invoice before you sign and accept the shipment. Should
    your vehicle been damaged in transit, then this information will be very important when filing a claim. Additionally, you
    should have a digital camera on hand to take pictures of any damages you find. Take the pictures in such a way that
    you can see the driver or the delivery vehicle in the picture.
    11. For smaller units, like the youth ATV, they will come strapped to a small pallet, in a heavy cardboard box that may not
    have a safety cage. Make sure the corners and not mashed in. If there is significant wear and tear to the cardboard,
    then open up the box and make sure you don’t see any damage before you accept and sign for the delivery.
    12. Your MSO documentation will soon follow your order. We do not send the registration documents along with the
    vehicles for obvious reasons. Please call 877-300-8707 to request your MSO documentation upon receipt of your
    delivery and please have your Vehicle Identification Number on hand.
    13. Once you have your unit prepared, if you notice anything missing or damaged, file an online claim, and our staff will
    prepare your claim and contact you if delivery or resolution will be longer than stated on the claims page. Parts
    normally take 5-21 business days to receive and can take longer if we have to special order a part from the factory.
    14. We may cancel your order only if we’re unable to fulfill and ship your order within 5 business days. You may also
    cancel your order if your item has not been shipped. However you will be charged a 6% cancellation fee. Once the item
    is shipped, the order cannot be cancelled. If you choose to cancel your order once it has been shipped, or you reject
    delivery for any reason (other then authorization by Joy Ride Motors for you to reject due to catastrophic shipping
    damage) then you'll be charged for the cost of the return shipping and a 25% restocking fee.

    3) WARRANTY – ASSEMBLY - SAFETY - PDI

    A: We do have staff technicians on site to assist you with any questions or assistance you may need resolved with
    your product. Please remember that you are purchasing your item wholesale, skipping dealer location and touch,
    because we are not physically on location with you, you will need to be our eyes and hands to walk you through any
    warranty or technical issues and have patience with this process. If there are any technical issues that cannot be
    resolved over the phone or through email then the customer will take the unit to a certified mechanic for diagnosis.
    We suggest http://www.superpages.com/ and search ATV Dealer, Scooter Dealer or Small Engine Repair Shop to
    best locate them. Please remember, the parts are included in your warranty however the labor naturally is not. If
    there is a significant issue, JoyRideMotors.com reserves the right to decide what actions be taken above a standard
    warranty agreement.

    B: Please remember that by purchasing a motorized vehicle online under wholesale pricing, thus shipping a
    certified mechanic touch, you are responsible for performing the setup that a dealer would normally perform - such
    as checking the tires, hooking up the battery, checking tightness of all nuts and bolts, changing oil, etc. Although we
    do provide some very good information and assembly manuals; occasionally some units may need additional
    attention and other routine items checked/adjusted such as adjusting the carburetor idle and mixture screws,
    checking to ensure wires are well connected, adjusting chain slack and alignment, if needed. Since you are
    skipping a dealer and saving over half the price of a usual retail customer, you will need to perform the final assembly
    (as stated above). While we will gladly assist you with any technical questions, there will be no valid manufacturer
    warranty we will cannot refund or exchange your unit if you cannot perform these functions or refuse to let a shop
    do it for you. By placing an order with JoyRideMotors.com you agree to these terms.

    C: Standard Warranties offered via JoyRideMotors.com are not those of JoyRideMotors.com but rather the MFG.
    Extended and Limited Life-time warranties offered by JoyRideMotors.com are that of JoyRideMotors.com

    D. Purchaser accepts all responsibility to inspect their product or vehicle prior to every use and to make sure that
    the equipment is in safe and mechanical order. If purchaser is not qualified to inspect and service the equipment,
    they are solely responsible to have any service or inspection performed by a certified mechanic. Purchaser is also
    solely responsible to wear all proper and typically recommended safety equipment when operating their vehicle.

    4) MSO – REGISTRATION - TITLE

    The MSO (manufacturer certificate of origin), along with your "bill of sale" are mailed to you upon request.
    MSO / MCO / Title requests, if processed correctly, will generally take 3-21 Business days to arrive via Priority Mail.
    In order to receive these documents, you must request them via email. Please email your request to
    MSO@joyridemotors.com. Make sure your request includes your; Name, Phone Number, Address, the Invoice
    Number, Vehicle Identification Number and Engine Number.

    Once you receive both your MSO and BILL OF SALE, simply take those two documents to your local DMV to complete
    any necessary registration forms and they will generate you the final, original Title of Ownership. There are generally
    blank mso | mco documents with the item when it arrives that should assist you until your original title arrives from
    your DMV. Joy Rides is NOT a title agency. We only provide you with all the manufacturers documentation needed to
    register and receive a title in your state. We complete requests daily. If you did not receive a MCO/MSO with your
    vehicle then you must request one to receive it.

    The MSO provided will arrive separately in most cases than your vehicle for your personal fraud protection and some
    state legal requirements. Registration is the responsibility of the purchaser. We can assist you with any questions.
    Delivery from the date of request of a title / mco takes about 1-2 weeks however can take up to 4 weeks in rare cases
    and special situations.

    Please understand that laws in every state are different, make sure you research and understand the laws in your state
    regarding your purchase. We have linked every US Department of Motor Vehicles for you to validate any questions
    under htpp://www.JoyRideMotors.com/FAQ . Check with your local DMV and state laws to find out what they required for
    using your purchase on public and.or private lands. All Street Legal Vehicles we offer are DOT and EPA certified and
    marked models will carry a CARB Certification.

    For On-Road vehicles (motorcycles, scooters, etc.), your warranty period begins when your MSO documents are sent
    out. Your warranty is not valid until your MSO is complete, and failure to request MSO within 2 weeks of receipt of your
    vehicle will void out the warranty entirely. The warranty period for Off-road machines (atv, go karts and dirt bikes)
    commences on the date of delivery.

    If you need replacement MSO documentation because it was lost, damaged or stolen there is a documentation
    replacement fee of $54.99. If your state requires any Notarization, then that fee will be charged at $30/per title. These
    fees are non refundable and non-negotiable. Please be sure verify if you need a notarize title or bill of sale before
    we send your MSO and Title to save time and money on return shipment. If you wish to expedite the shipping of your
    MSO documentation then you will be responsible for any Express Mail Delivery charges.

    5) THERE IS NO COOLING OFF PERIOD:

    Per US National Law when making a vehicle purchase the customer must understand and agree that they will not
    initiate a return with the written agreement from JoyRideMotors.com | San West, Inc. California law does not
    provide for a "cooling-off" or other cancellation period for vehicle lease or purchase contracts. Because this sale
    generated in California, the customer no matter the state will abide by this requirement. Therefore, you cannot later
    cancel such a contract simply because you change your mind, decide the vehicle costs too much, or wish you had
    acquired a different vehicle. After you sign this motor vehicle purchase contract, it may only be canceled with the
    agreement of the seller JoyRideMotors.com for legal cause, such as fraud. However, California law does require a
    seller to offer a 2-day cancellation option on used vehicles with a purchase price of less than $ 40,000, subject to
    certain statutory conditions. This contract cancellation option requirement does not apply to the sale of a motorcycle
    or an off-highway vehicle subject to identification under California law. See the vehicle contract cancellation option
    agreement for details.11709.2 California Vehicle Code

    6) VEHICLE RETURN POLICY:

    If approved by JoyRideMotors.com, I understand that I must first acquire a return authorization code from
    JoyRideMotors.com | San West, Inc. and ship the item back and only if approved for return by JoyRideMotors.com |
    San West, Inc. Returns must be in 100% new, unused, un-fuelled and re-sellable condition. Then and only then will I
    be given a credit upon receipt of the return merchandise back with the warehouse. I also understand that there will
    be a 25% restocking fee for a return to cover the customer's desire to cancel and the cost of return item shipping. An
    invoice will be provided for these fees. Returns are only accepted if WE authorize such and only under special
    circumstances deemed by US. You may be approved for a refund after the product has been returned and received
    safely by our staff. Reason for a return are also listed in the money back guarantee however are if the machine is
    non-operational and must be validated by a mechanic, not as described or does not operate after a proper mechanic
    assembly. We cannot refund or exchange your purchase if you refuse to let a mechanic validate your reasons for
    return. Because the customer is buying wholesale and having the machine delivered direct to them, they understand
    that some attention is needed for assembly and if parts are missing upon delivery that does not constitute a return.
    The parts will immediately be sent upon request via the Warranty Claims form located on the main home page. The
    customer agrees that they will properly file all claims via our automated forms located on the home page. This
    agreement also applies to customers who have already accepted the merchandise, used and the simply changes
    their mind FOR EXAMPLE: “My wife found I ordered out and told me to cancel because she didn’t want it anymore”. A
    return is not validated and a standard restocking fee of 25% will be collected.

    7) 14 DAY TRIAL POLICY:

    JoyRideMotors.com offers a return policy which is 14 days from the date of order. If this time frame has passed
    there will be no refunds or returns abiding by state law. The customer has 14 days from the original first date of
    shipping from the warehouse to return the vehicle. Said vehicle must be in original packaging, unused and no fuel
    have passed through the gas tank or fuel lines.

    8) VEHICLE RETURN POLICY: ATV, MOPED, SCOOTER, DIRTBIKE, GO KART MOTORCYCLE.

    "Manufactures defects/missing parts will only be covered the first 30 days" Then by default the warranty will
    take over. There are absolutely no refunds for any fueled items or used items regardless of damage or
    performance, all sales are final. Any unauthorized packages returned without a valid RMA number written on the
    exterior packaging will be refused and sent back to the customer. Freight collect and COD packages will not
    be accepted.

    9) PARTS RETURNS POLICY

    Customers are responsible for the freight charge associated with this return, please do not send the product back
    to us "Freight collect", as the warehouse will refuse the shipment and it will be returned to you by the carrier. All
    returns are subject to a 25% restocking fee. Refund does not include the original shipping charge, if any

    10) APPROVAL TO PROCESS PAYMENT:

    By Checking the Acceptance of the terms and conditions box upon checkout, I certify that I am the card holder who is
    paying for these goods. I hereby authorize JoyRideMotors.com to “authorize” payment of which I have will securely
    provide below. I understand providing this information is for the sole purpose of payment for the goods I am ordering
    now. I understand my payment will first be “authorized” when my order begins to process and will be “Payment
    Captured” at the time of shipping my merchandise per federal law. I may be contacted by JoyRideMotors.com
    accounting staff to provide further proof of ownership of this payment. Orders shipping to a gift address will be
    required to fax a copy of identification with a written request to ship to an alternate “gift” address. I may be asked to
    contact my bank and add additional addresses to my file so that JoyRideMotors.com can safely ship my merchandise
    with buyer protection always in mind. Failure to do so, may result in cancellation of my order. I also understand
    JoyRideMotors.com will not use this information for any other use than what I have given permission for. This
    information will immediately be deleted upon payment of my order by JoyRideMotors.com.

    11) TERMS OF SERVICE REVIEW BELOW

    I understand Free Delivery is 3-15 Business Days I will make notes on my Delivery Slip (BOL) before signing if any
    damages are visible. (stated above) There is an extended labor warranty available for purchase in the warranty
    department. I understand Labor IS included “in-house” at the BMS Facility in City of Industry OR JoyRideMotors.com
    facility in San Diego CA.

    I understand labor is not included in the standard purchase price and MFG warranty. I understand my Standard
    Vehicle Warranty is a Manufacturer Warranty and not an Extended Services JoyRideMotors.com / San West Warranty.
    This means should you locate a more convenient dealer in your area, your parts warranty is still 100% valid
    and is transferable.

    I understand some vehicles arrive “Pre-Assembled” although this does not mean a PDI has been completed
    because we cannot ship vehicles fueled and batteries installed. The PDI (pre-delivery inspection) is recommended
    by the manufacturer to initiate your warranty. Skipping this step, can cause your vehicle to not operate properly. Without
    proper “break-in” and without proof of a certified assembly, the Manufacturer parts warranty and proper operation of the
    unit cannot be guaranteed until completion. The MFG will not authorize a return unless this has been done. Your
    warranty parts warranty will however be honored regardless.

    NOTE: Upon submission, the person placing this order and accepting these terms and conditions of purchase will
    receive a copy of this to the email address provided.

    JOYRIDEMOTORS.COM HAS PRICED ITS PRODUCTS UPON THE UNDERSTANDING, AND YOU HEREBY
    ACKNOWLEDGE THE UNDERSTANDING, THAT JOYRIDEMOTORS.COM | SAN WEST INC | BUGGY WORLD WILL
    NOT BE RESPONSIBLE OR LIABLE FOR ANY FORM OF CONSEQUENTIAL, INCIDENTAL, STATUTORY, PUNITIVE,
    EXEMPLARY OR INDIRECT DAMAGES OF WHATEVER KIND OR TYPE ARISING FROM ANY TYPE OF COMMERCIAL,
    BUSINESS, ENVIRONMENTAL, TORT, WARRANTY, CONTRACT, STRICT LIABILITY OR OTHER CAUSES ARISING
    DIRECTLY OR INDIRECTLY FROM OR IN CONNECTION WITH ANY PRODUCT AND/OR ITS USE.

    12) INDEMNIFICATION:

    YOU AGREE TO DEFEND, INDEMNIFY AND HOLD COMPLETELY HARMLESS JOYRIDEMOTORS.COM, SAN WEST
    INC. FROM AND AGAINST ANY AND ALL CLAIMS, DAMAGES, COSTS, AND EXPENSES, INCLUDING ATTORNEYS'
    FEES, ARISING FROM OR RELATED TO YOUR USE OF THE PRODUCTS PURCHASED VIA THE SITE. NO IMPLIED
    WARRANTIES OR AGREEMENTS: THERE ARE NO AGREEMENTS OR WARRANTIES, EXPRESSED OR IMPLIED
    INCLUDING WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN
    THOSE STATED IN THIS AGREEMENT. JOYRIDEMOTORS.COM SHALL NOT BE RESPONSIBLE FOR THE PAYMENT
    OF DAMAGES or TIME VESTED, OTHER THAN THE SUMS SPECIFIED IN THIS AGREEMENT AND LIMITED
    WARRANTY, FOR INCIDENTAL OR CONSEQUENTIAL LOSS OR DAMAGE ARISING FROM INJURY, LOSS OF USE,
    LOSS OF TIME, RENTAL VEHICLES, PROFITS, OR INCOME TO THE CUSTOMER AS A RESULT OF A FAILURE OF ANY
    COMPONENT OR PART.
